The Chief E xecutive Officer of Ford, Jacques Nasser, thought that this recall format was too slow and unacceptable. He insisted that customers be allowed to replace their tires with tires from other manufacturers and that they be reimbursed for the costs by Firestone. In order to speed up the process, Bridgestone began to fly in tires from Japan and Ford idled one of its E xplorer assembly plants for two weeks in order to free up more tires for the recall process. The recall was a major blow to Firestone, which was once one of the most admired corporations in the United States. The decision of the National Labor Relations Commission dated December 28, 1984 is reversed and set aside. Petitioner Firestone Tire and Rubber Company of the Philippines is directed to pay its dismissed worker Carlos Lariosa the separation pay to which he may be entitled under the law, or any collective bargaining agreement or company rules or practice, whichever is higher. As a tire builder, Lariosa was entrusted with certain materials for use in his job.

They revolted and replaced the 1973 Constitution with the 1987 Constitution. “Such beliefs, however, should not be equated with a desire to perpetuate a particular official or group of officials in power. My firm conviction that there is an adequate law implementing the constitutional right of initiative does not ipso facto result in the victory of the PIRMA petition or of any proposed constitutional change. There are, after all, sufficient safeguards to guarantee the proper use of such constitutional right and to forestall its misuse and abuse. First, initiative cannot be used to revise the Constitution, only to amend it. Second, the petitioners’ signatures must be validated against an existing list of voters and/or voters’ identification cards.

It bears stressing that Citibank could not have missed the non-negotiable nature of the withdrawal slips. The essence of negotiability which characterizes a negotiable paper as a credit instrument lies in its freedom to circulate freely as a substitute for money.12 The withdrawal slips in question lacked this character. This petition assails the decision 1 dated December 29, 1993 of the Court of Appeals in CA-G.R. CV No. 29546, which affirmed the judgment 2 of the Regional Trial Court of Pasay City, Branch 113 in Civil Case No.

The signature sheets do not explain this discrimination against the Senators. The 6.3 million people who signed the signature sheets could not have known that their signatures would be used to discriminate against the Senators. They could not have known that their signatures would be used to limit, after 30 June 2010, the interim Parliament’s choice of Prime Minister only to members of the existing House of Representatives. Section 5 does not state that the elections for the regular Parliament will be held simultaneously with the 2007 local elections. This section merely requires that the elections for the regular Parliament shall be held simultaneously with the local elections without specifying the year. The Lambino Group never alleged in the 25 August 2006 petition or the 30 August 2006 amended petition with the COMELEC that they circulated printed copies of the draft petition together with the signature sheets. Likewise, the Lambino Group did not allege in their present petition before this Court that they circulated printed copies of the draft petition together with the signature sheets.

Clearly, following the foregoing procedural rules, the COMELEC is not authorized to conduct any kind of hearing to receive any evidence for or against the sufficiency of the petition for initiative. Rather, the foregoing rules require of the COMELEC to determine the sufficiency or insufficiency of the petition for initiative on its face. And it has already been shown, by the annexes submitted by the petitioners themselves, their petition is, on its face, insufficient in form and substance. The remand of the case to the COMELEC for reception of evidence of the parties on the contentious factual issues is, in effect, an amendment of the abovequoted rules of the COMELEC by this Court which the Court is not empowered to do. The respective explanatory notes of the said Senate and House bills uniformly recognize that there is, to date, no law to govern the process by which constitutional amendments are introduced by the people directly through the system of initiative. As earlier shown, Congress and other government agencies have, in fact, abided by Santiago. When the COMELEC denied the petition for initiative, there was as yet no valid law enacted by Congress to provide for the implementation of the system. Amendments to this Constitution may, likewise, be directly proposed by the people through initiative, upon a petition of at least twelve per centum of the total number of registered voters, of which every legislative district must be represented by at least three per centum of the registered voters therein.

Neither should the exercise of this power be made subject to any conditions, as some would have us accept. It is important to note, however, that while the Decision in the Santiago case pronounced repeatedly that Republic Act No. 6735 was insufficient and inadequate, there is no categorical declaration therein that the said statute was unconstitutional. The express finding that Republic Act No. 6735 is unconstitutional can only be found in the separate opinion of former Chief Justice Davide to the Resolution in the PIRMA case, which was not concurred in by the other members of the Court. Even though it is conceded that the first three requisites are present herein, the last has not been complied with. Undoubtedly, the Santiago case and the present Petition involve different parties, subject matter, and causes of action, and the former should not bar the latter. After a careful reading, however, of the Santiago case, I believe in earnest that the permanent injunction actually issued by this Court against the COMELEC pertains only to the petition for initiative filed by Jesus S. Delfin, and not to all subsequent petitions for initiative to amend the Constitution. – The Commission shall act on the findings of the sufficiency or insufficiency of the petition for initiative or referendum. Legislative district must be represented by at least three percent (3%) of the registered voters therein. The law mandates upon the election registrar to personally verify the signatures. This is a solemn and important duty imposed on the election registrar which he cannot delegate to any other person, even to barangay officials.

The resolution, order or decision of the Commission on any of the foregoing cases shall have the force and effect of a regular administrative resolution, order or decision and shall be binding upon the parties therein and upon the agency having jurisdiction over the same. Said resolution, order or decision shall become final and executory within thirty days from its promulgation and shall be appealable by certiorari only to the Supreme Court. The Ford Motor Company released documents showing that in 1997 Bridgestone/Firestone began receiving numerous complaints of injuries and property damage involving certain Firestone tires that were not recalled until August 2000. Some of the recalled tires have rates of injury and damage claims up to 100 times greater than for tires not recalled, Ford disclosed today. Vehicle owners sent many of those claims to Bridgestone from 1997 to 1999, but the tire makers did not tell Ford, the company said. Ford’s new automobiles, particularly Ford E xplorer sport utility vehicles, are equipped with two-thirds of the recalled tires. Bridgestone officials did not dispute Ford’s data but said the problem had not caught their attention until Ford began reviewing Bridgestone’s files in July 2000. The overall rate of complaints on tires from all Bridgestone factories has not been unusually high, and Bridgestone did not conduct the detailed review of tire quality by factory that Ford undertook, said Bob Wyant, Bridgestone’s vice president of quality assurancexxiv.

The Lambino Group did not attach to their present petition with this Court a copy of the paper that the people signed as their initiative petition. The Lambino Group submitted to this Court a copy of a signature sheet20 after the oral arguments of 26 September 2006 when they filed their Memorandum on 11 October 2006. The signature sheet with this Court during the oral arguments was the signature sheet attached21 to the opposition in intervention filed on 7 September 2006 by intervenor Atty. In turn, an office “refers, within the framework of governmental organization, to any major functional unit of a department or bureau including regional offices. It may also refer to any position held or occupied by individual persons, whose functions are defined by law or regulation.” Accordingly, we shall limit our review to ascertaining if the proceedings before public respondent COSLAP are without or in excess, of its jurisdiction. In this wise, a recounting of the history of the COSLAP may provide useful insights into the extent of its powers and functions. Because the Constitution provides for certain qualifications for the presidency and provides for a separate impeachment process to remove a future president from office, Congress does not have the power to enact legislation that would apply to presidential candidates.

The provincial delegations requested financial assistance for the construction of roads, public markets, municipal buildings, artesian wells, irrigation systems, and other projects in their respective localities. Headed by Maximo Encarnacion, the delegation informed the President that the Bureau of Customs required licenses for mechanics and patrons of their fishing boats. Aside from these, the bureau also saw to it that each crew member was provided with a life-belt and the ship itself equipped with a medicine chest. Failure to comply with these regulations, the fishermen said, would result in a fine of from P50 to P500. December 4.—THIS morning, Valerian Cardinal Gracias, visiting, archbishop of Bombay, India, officiated at a special mass at the Malacañang chapel. A small choir that included the President’s daughter Milagros sang at the mass. Assistant Executive Secretary Quema said that Malacañang had conducted an investigation of the case and found out that there was no nepotism Involved as reported. Quema explained that the directive of Malacañang ordering the appointment of de Guzman was based on the facts that he topped the examination given for the position and that he is a civil service eligible and a veteran. Malacañang ordered the cancellation of the temporary appointment of Ciriaco Tawatao, Jr., a law graduate, who had been temporarily designated to the position in question. MEANWHILE, Assistant Executive Secretary Enrique Quema issued a directive, by authority of the President, to the Department of Agriculture and Natural Resources ordering the immediate appointment of Maximo de Guzman, who had topped the examination given for the position of education and information officer of the Agricultural Tenancy Commission.

  • Among the delegations that called at Malacañang this day were that from Nueva Ecija, composed of municipal officials and farmers, led by Rep. Celestino Juan and Governor-elect Amado Aleta;.
  • In summary, it would seem that any major change in governmental form and scheme would probably be interpreted as a “revision” and should be achieved through the more thorough process of deliberation.
  • The load on the tires can affect the temperature of the materials inside the tire, which Firestone measured with an internal thermometer.

It is worth noting that Ford sold the E xplorer with Firestone tires . Ford establishes the specifications for the tires and the supplier has to meet the specifications. Usually if a part in a vehicle breaks, a consumer typically will not go to the supplier, but will file a complaint with the car company. The tires have their own identity and the warranty is covered by the tire manufacturer and not by Ford. Said that a majority of its new 2002 E xplorer sport utility vehicles will come equipped with Michelin tires. Michelin of France was scheduled to get 55 percent of the business when the contracts were signed in 1997; well before Firestone’s tire problems came to light. stole my deposit Industry experts say SUV tires typically cost auto makers about $40 each, indicating that the wholesale cost of four replacement tires and a spare could come to $200 a vehicle.
